      Law Submission

       

      The Women's Council for Domestic and Family Violence Services (WA) will be making a submission to the Department of the Attorney General regarding the proposed legislative changes to the Children and Community Services Legislation Amendment and Repeal Bill 2014 (the Bill) as introduced to parliament on the 24/09/2014.

       

      The Bill sets out the Government’s intentions to repeal and amend sections of the Children and Community Services Act 2004 (the Act). The purpose of this Bill is to amend the Act to implement the majority of legislative recommendations of the 2012 Report of the Legislative Review of the Children and Community Services Act 2004. The Bill is also to repeal the Parental Support and Responsibility Act 2008 (the PSR Act), Parental Support and Responsibility Regulations 2009 (the PSR Regulations) and the Parental Support and Responsibility (Disclosure of Information) Guidelines 2009 (the PSR Guidelines) and consequentially amends the Children’s Court of Western Australia Act 1988 and the Young Offenders Act 1994.

       

      The Women’s Council would specifically like to respond to the proposed amendments in Part 4, Division 7, Section 101.; Failing to protect child from harm. Section 101 amended. Delete section 101(1)(a)(iii) and (iv) and insert: “(iii) emotional abuse as defined in 15 section 28(1); or”.
